What are your policies on SPAM?


Email Spamming or Unsolicited Advertisements Is Not Allowed
Please read the following concerning email and spam very carefully...

BUMMER HOSTING SOLUTIONS HAS A ZERO TOLERANCE POLICY FOR SPAM IN ANY FORM.

Commercial advertisements with e-mail unsolicited commercial advertisements are not allowed in e-mail (commonly known as SPAM or UCE) and will result in account suspension or cancellation, without refund.

Commercial advertisements are un-welcome in most Usenet discussion groups and on most e-mail mailing lists. Inappropriate posting may result in account suspension or cancellation. See the newsgroup or mailing list's charter for whether advertising is
allowed or not. Spamming or sending a message to many different off-topic newsgroups is particularly unethical and will be treated as such breach of this ethical policy.

Sending a message is by itself spamming UNLESS the individuals have specifically requested to be added to a mailing list on that topic. E-mail is a person-to-person medium, not a broadcast medium. Accepted are opt-in mailing lists where the recipients have
explicitly requested to receive advertisements and have an opt-out option. Proof must be made that recipient has opted-in to receive advertisements and/or newsletters in case of a complaint.

All email terms agreed to above must be adhered to by all Bummer Hosting Solutions clients - there are NO exceptions. Should any domain or IP address used or owned by Bummer Hosting Solutions be placed on a spam database or spam list, the offending client
will bear full financial responsibility for correcting any spam issues or problems if the terms above have not been adhered to. This includes any costs incurred by Bummer Hosting Solutions including research fees, attorney fees, and any other fee which may be
encountered.

Our anti spam policies are very clear. They must be agree to via the terms when signing up for web hosting services. If you do not agree, you can NOT sign up for hosting services. You can view (and print) the terms at Hosting Terms or download them in PDF format in your billing account or tech support account.

When we get spam complaints, it's easy to clear up when we can PROVE that people signed up for and requested to be place on mailing lists. This is done via the "double opt in" in our mass mailing lists. This provides federal, state, and local municipality legal protection for our clients and us. If it's not used, you and/or we can be sued in court.

In addition, people will report spam to the spam databases. If you are reported, that means your email plus that of our other clients will be refused. Our IPs then get blacklisted by spam databases and the email sent by our clients and us will not arrive to almost 50% of their destinations. For us to rectify any spam related problems created when we have no proof of sign ups, it costs on average of $100 - $400 - not to mention the time it takes to do this.

Please understand, SPAM has serious legal and monetary implications. It's unfortunate that it has to be handled this way, but spam is something people detest and get very upset about.

Mass Mailing Policies
3rd Party Mass mailing services:
Most of these companies are overseas, to avoid prosecution from U.S. Spamming Laws. If you use a 3rd party Mass Mailing company, much of your email will not get to the intended people because it's blocked by spam databases.

If you want to keep people updated, use something like a blog they can subscribe to. This is great for search engines and will increase your traffic. We can set up Word Press for you if you have a database available with your hosting plan. This can be used like an RSS feed, where people subscribe, notifying them when there is an update. The Blog software is easy to use and you can make changes on it in seconds.

- If using a Mass Mailing program: Be aware: ALL websites providing mass mailing MUST have a removal option next to ALL sign-up boxes. An example can be seen at Contact Page.

- ALL email must have a REMOVAL LINK clearly posted at the bottom of each mass mailing sent.

- ALL mass mailing lists MUST provide PROOF of double opt-in. Our own mass mailing software provides this. However, you MUST configure and allow for "Double Opt-in", within your Mass Mailing Admin. It is not automatically configured this way. This is your responsibility.

- Just because a client makes a purchase, it does NOT mean you can place them in a mass mail list. They must SIGN UP and double opt-in!

- No one is exempt from our email terms. This includes Bummer Hosting Solutions and our clients, non-profit organizations, religious organizations or clients with shopping carts or membership areas.

ALTERNATIVES TO MASS MAILING

- An EXCELLENT alternative to mass mailing is setting up and operating a blog page. They're easy to use, great for search engine traffic, and you cannot be sued for spamming.
